# Terms of Service

Shager is operated by יניב פרסלר (Yaniv Presler). By using Shager you agree to these terms, to the [Privacy Policy](/en/privacy) and to the [Acceptable Use Policy](/en/acceptable-use). If you use Shager on behalf of a company, you confirm that you may bind it, and "you" means that company.

Shager is a business service. It is meant for agencies, marketers and companies, not for consumers.

## The service

Shager lets you schedule, get client approval for, and distribute content to social media accounts you manage, and measure clicks and leads. It publishes only through each network's official API.

Live networks today: Facebook Pages, Instagram professional accounts and YouTube. TikTok and LinkedIn are coming soon and are not yet available.

## Your account

- Give accurate details and keep them up to date.
- Keep your and your team's sign-in details safe. You are responsible for what happens under your account, including what your team members do.
- Tell us at yaniv.presler@gmail.com if you think your account has been accessed without permission.

## Your responsibilities

- Connect only accounts you are authorized to manage, and publish only content you have the right to publish.
- Follow each network's terms, including the [YouTube Terms of Service](https://www.youtube.com/t/terms), Meta's terms and every network's community guidelines. By connecting a YouTube channel, you agree to be bound by the [YouTube Terms of Service](https://www.youtube.com/t/terms), and Google's handling of that data is described in the [Google Privacy Policy](https://policies.google.com/privacy).
- Do not use Shager for spam, deception, impersonation, unlawful content, or to evade networks' limits or detection systems. The full list is in the [Acceptable Use Policy](/en/acceptable-use).
- If you enter other people's personal data (for example your clients' approval contacts or leads), make sure you are allowed to, and that you have told them as the law requires.

## Your content

Your content stays yours. You allow Shager to store, process (for example convert an image format) and publish it to the accounts you choose, only to provide the service.

You are responsible for your content and for the results of publishing it. We do not review content before it is published.

## Clients and personal data

When you put your clients' data or their audiences' data into Shager, you are the controller and we are your processor. Our [Data Processing Addendum](/en/dpa) is part of these terms and applies automatically.

## AI writing assistant

The writing assistant suggests text. Its suggestions may be wrong or unsuitable. Check them before you publish. You are responsible for what you publish.

## Fees

Paid plans, if you use one, are charged as shown in your order or on the pricing page at the time you sign up. We will give you at least 30 days' notice before a price change that affects you. Fees are not refundable unless the law requires otherwise or we agree in writing.

## Availability and changes

The service is provided as is. Networks change their APIs and may reject or limit posts; their decisions are not ours. There may be maintenance downtime. We do not promise any reach, engagement or number of leads.

We may change or improve features. If we remove a feature that is central to a paid plan, we will tell you in advance.

## Suspension and termination

We may suspend accounts that break these terms or the Acceptable Use Policy, or that put the service, the networks or other people at risk. Where possible we will tell you first and give you a chance to fix the problem.

You can stop using Shager and ask us to delete your account at any time by writing to yaniv.presler@gmail.com. Before deletion you can export your data. After deletion, data is removed as described in the [Privacy Policy](/en/privacy).

## Self-hosted installations

If you run Shager on your own servers, you are the operator of that installation. You are responsible for its security, backups, updates, legal pages and compliance, and for the network developer apps you connect to it.

## Limitation of liability

To the fullest extent the law allows, we are not liable for indirect or consequential damages (such as lost profits, lost data, lost reach or business interruption), and our total liability is limited to what you paid us in the last 12 months.

Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud or wilful misconduct.

## Indemnity

If a third party makes a claim against us because of content you published through Shager or because you broke these terms, you will cover our reasonable costs of that claim.

## Changes to these terms

If we change these terms, we will update the date at the top. If a change matters, we will tell account holders at least 14 days in advance. If you keep using Shager after the change takes effect, the new terms apply.

## Law and jurisdiction

These terms are governed by Israeli law; the courts of Tel Aviv-Jaffa have exclusive jurisdiction.
